Terms of Service
These Terms of Service (“Terms”) are the agreement between RT Express (“we”, “us”), of Cincinnati, Ohio, operating the RT Track GPS tracking service, and the business customer that accepts them (“you” or “Customer”). By checking “I agree” during onboarding, creating an account, signing a Service Agreement, or using the service, you accept these Terms on behalf of that business.
1. What RT Track is
RT Track is a commercial GPS tracking and equipment-monitoring service for fleet assets — typically refrigerated trailers, trucks, and other wired equipment you own or are authorized to manage. The service includes:
- a password-protected web portal (live map, history, alerts, geofences, team access);
- receipt of location reports from SinoTrack ST-901-class trackers configured to our servers;
- cellular connectivity on a SIM we supply, and outbound email/SMS alerts you configure;
- hardware we provide for use with the service, as described in the Hardware & SIM Terms.
We sell a United States service to U.S. businesses. The portal is at
gps.rtohio.com.

3. Accounts and authority
You must be a business, not a consumer, and at least 18 years old. The person who accepts these Terms during onboarding represents that they are authorized to bind the Customer. You are responsible for every user you invite, for keeping credentials confidential, and for activity under your account. Tell us promptly if you believe an account was misused.
Each company is a separate tenant. Users see only the companies they belong to. We never take
tenant_id from the browser — access is determined by your login.
Roles (viewer, dispatcher, tenant admin) are enforced on the server. A viewer cannot change fleet settings just because the screen hid a button.
4. What you may track
RT Track is for equipment and fleet assets you own or are legally authorized to monitor. It is not a people-tracking, employee-surveillance, or consumer location product. You must not use it to track a person, a privately owned vehicle, or any asset you do not have the right to monitor. You are solely responsible for notices to drivers, unions, or other parties if your own policies require them.
You must not rely on RT Track as:
- an ELD, hours-of-service, IFTA, or other FMCSA compliance device;
- a cargo-security, theft-prevention, or insurance substitute;
- a life-safety, 911, or emergency-dispatch system;
- a temperature, door, or cargo-condition monitor — this hardware does not report those.
We do not offer, enable, or support remote engine cutoff, immobilization, or starter interrupt (sometimes called “yellow wire”, S20, or SMS 940). Do not ask us to.
5. Hardware and SIMs
Unless a signed order says you are buying the units, trackers, SIMs, harnesses, and accessories we supply remain property of RT Express. Your monthly fee covers use of that equipment plus connectivity and the software. Details, care, lost-unit charges, and RMA swaps are in the Hardware & SIM Terms. You must return equipment when the service ends.
6. Fees
Fees are quoted per tracked unit (or as otherwise written on your order), typically monthly, with no per-seat charge. We invoice most fleets (NET-30 unless your order says otherwise) and may offer card or auto-pay. Taxes are extra. Billing, the 30-day satisfaction refund, late payment, and cancellation are in Refunds & billing.
7. The service — and what we do not promise
We will provide the service with reasonable care. GPS location, cellular coverage, map tiles, and reverse-geocoded addresses all depend on third parties and on how the unit is installed and powered. Reports can be late, missing, or inaccurate. Offline buffering on the device helps, but it is not a guarantee.
Availability is best effort. We do not sell an uptime percentage, and we do not issue service credits. Support hours and what “platform down” means are in the SLA.
Position history is kept for the retention period on your account (the public default is 12 months unless we agree otherwise in writing). You can export history while your account is active.
8. Your data
As between us, you own your fleet data (asset names, positions, alerts, geofences, team roster). We process it to provide, secure, and support the service, as described in the Privacy Policy and DPA. We do not sell it. We host it on infrastructure in the United States, with encrypted off-site backups.
You grant us a limited license to host and process that data, and to use de-identified, aggregated operational statistics (for example, overall ingest volume) that cannot reasonably identify you or your assets.
9. Acceptable use
You must follow the Acceptable Use Policy. We may suspend access, without refund for the suspended period, if we reasonably believe your use threatens the platform, another customer, or the law. We will try to notify the account admin first unless we must act immediately.
10. Term, suspension, and end of service
The service runs month to month unless your order sets a term. After the 30-day satisfaction window, you may cancel effective at the end of the current billing period by emailing dan@rtohio.com. We may stop providing the service to you for non-payment, AUP breach, or if we discontinue RT Track (we will give at least 30 days’ notice when we discontinue, except for non-payment or AUP).
When service ends you must return our equipment. We will, on written request within 30 days, provide a reasonable export of your then-available history. After that we delete or anonymize live customer data on the schedule in the Privacy Policy, except backups that expire on rotation and anything we must keep for law, dispute, or a legal hold you have asked us to honor.
11. Warranties and limitation of liability
THE SERVICE AND EQUIPMENT ARE PROVIDED AS IS AND AS AVAILABLE. To the fullest extent permitted by law we disclaim implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that GPS points, alerts, or maps will be uninterrupted, timely, or error-free, or that they will prevent loss, theft, or downtime of your equipment.
TO THE FULLEST EXTENT PERMITTED BY LAW, RT EXPRESS AND ITS OWNERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST CARGO, LOST BUSINESS, OR COST OF SUBSTITUTE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY.
OUR TOTAL LIABILITY ARISING OUT OF THESE TERMS OR THE SERVICE IS LIMITED TO THE FEES YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM. Some states do not allow certain limitations; in those states our liability is limited to the maximum permitted.
This section survives the end of the service.
12. Indemnity
You will defend and indemnify RT Express against claims arising from (a) your use of the service in violation of these Terms or law, including unauthorized tracking; (b) your installation or wiring of equipment; (c) content or names you put in the portal; or (d) a dispute between you and your drivers, shippers, or insurers about location or alert data.
13. Changes
We may update these Terms. For a material change we will notify account administrators by email or an in-portal notice and, when the change requires it, ask users to accept the new version before continuing. Continued use after the effective date is acceptance, except that a signed Service Agreement changes only if that agreement says so or you sign an amendment.
14. Governing law
These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law rules. Exclusive venue is the state courts in Hamilton County, Ohio, or the United States District Court for the Southern District of Ohio, except that we may seek injunctive relief in any court for misuse of the service or our equipment.
15. Miscellaneous
These Terms, the incorporated policies, and your order or signed Service Agreement are the entire agreement. You may not assign the agreement without our consent; we may assign it to a successor of the RT Track business. If a provision is unenforceable, the rest remains. A waiver must be in writing. Notices to us go to dan@rtohio.com; notices to you go to the tenant-admin email on the account. We are independent contractors. Force majeure includes cellular or GPS outages, map-provider outages, power or internet failure at the data center, labor disputes, and other events beyond reasonable control.
